By accessing or using the services provided by Fun Systems LLC ("Fun Systems," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Fun Systems provides website design, development, and marketing automation services for home service contractors. Our services include, but are not limited to: website design and development, marketing automation setup and management, missed call text-back systems, review funnel automation, lead follow-up sequences, database marketing campaigns, local SEO optimization, and Google Local Ads management.
Monthly subscription: Our core service is offered on a month-to-month subscription basis at $297/month. There is no setup fee.
Billing: Subscriptions are billed monthly in advance on the same date each month. Payment is due at the start of each billing period.
Add-ons: Google Local Ads management is available as an add-on service. Pricing for add-ons is determined on a case-by-case basis and communicated prior to engagement.
Ad spend: For Google Local Ads clients, ad spend is billed directly by Google to the client. Fun Systems' management fee is separate from and in addition to any ad spend.
You may cancel your subscription at any time by providing written notice to Fun Systems. Cancellation takes effect at the end of the current billing period. No partial-month refunds are provided.
Effect of cancellation: Upon cancellation, your website and all associated automations will be taken offline, as they are hosted and operated on Fun Systems' infrastructure. You retain ownership of any content, copy, and images you provided. If you wish to receive a copy of your website's code, please contact us within 30 days of cancellation.
Client content: You retain ownership of all content, logos, photos, and materials you provide to Fun Systems.
Fun Systems' work: The design, code, and automation configurations created by Fun Systems remain the property of Fun Systems while you are a subscriber. Upon cancellation, you may request a handoff of your website assets for an agreed-upon fee.
You agree to: provide accurate business information during onboarding; respond to Fun Systems' communications in a timely manner; provide any content, photos, or other materials needed for your website; and comply with all applicable laws and regulations.
Fun Systems provides its services "as is" and makes no warranty that our services will meet your specific business goals, generate a specific number of leads, or produce any particular revenue outcome. Marketing results vary based on factors outside our control, including your market, competition, pricing, and quality of service.
To the maximum extent permitted by law, Fun Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities, arising from or related to your use of our services. Our total liability to you shall not exceed the total amount paid by you to Fun Systems in the three months preceding the claim.
You agree to indemnify and hold harmless Fun Systems and its employees, contractors, and agents from any claims, damages, or expenses (including legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
These Terms of Service shall be governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.
We may update these Terms of Service from time to time. We will notify you of significant changes by email or by posting a notice on our Website. Continued use of our services after changes constitutes acceptance of the updated terms.
